Return, Refund & Cancellation Policy
Effective Date: 20 August 2020
This Return, Refund & Cancellation Policy applies to all products and orders placed through LyonsBarry® / Ballia Corpus through our website or other authorized sales channels.
1. Order Processing & Cancellation
Once an order is confirmed and payment is received, processing may begin immediately.
Order processing/fulfilment generally requires 7–15 business days. Certain products may require additional production, procurement, packaging, customization or regulatory processing and may require 30–45 days or longer before dispatch.
A cancellation request does not automatically guarantee cancellation or refund. Cancellation depends on the current status of the order and whether processing, procurement, production, packaging, documentation or fulfilment activities have already commenced.
Once an order has been dispatched, it cannot be treated as a cancellation request. Any subsequent request will be considered only under the applicable return/refund provisions and applicable law.
We reserve the right to reject cancellation requests where fulfilment activities have already materially commenced, subject to any mandatory consumer rights applicable to the transaction.
2. No Voluntary Return / No Exchange
All sales are final.
We do not normally accept returns or exchanges for:
Change of mind
Incorrect product selection
Incorrect quantity selected by the customer
Personal preference
Product no longer required
Refusal to accept a correctly supplied order
Delay caused by customs or government authorities
Customer-provided incorrect or incomplete delivery information
Failure to collect or receive the shipment
Products that have been opened, used, consumed, tampered with or whose original sealed packaging has been compromised may not be eligible for return.
Nothing in this policy excludes or restricts any consumer right that cannot legally be excluded or restricted.
3. Damaged or Incorrect Product
If an order arrives visibly damaged, tampered with, incomplete or contains an incorrect product, the customer must contact us within 72 hours of confirmed delivery.
Claims should include:
Order number
Customer name and contact details
Photographs of the complete parcel
Shipping/courier label
Photographs showing all sides of the parcel
Photographs of the product and packaging
Batch/lot number, where applicable
Description of the problem
Unboxing video, where available or requested
For high-value, fragile, sealed or health-related products, customers are strongly advised to record a continuous, clear and unedited video showing the unopened parcel from all sides, shipping label, package condition, opening of the parcel and inspection of the contents.
The parcel, packaging and product should be retained until the claim has been investigated and resolved.
4. Claim Verification
Submission of photographs or video does not automatically constitute acceptance of a claim.
All damage, shortage, incorrect-product and refund requests are subject to verification.
We may request additional evidence, including photographs, video, courier information, delivery records, package weight, invoice information, product details and other reasonable documentation required to investigate the claim.
If the evidence establishes that the product supplied was damaged or incorrect due to an issue attributable to us, an appropriate replacement or refund may be approved, subject to availability and applicable law.
5. Customer Return Responsibility
Where a return is approved, the customer must follow our written return instructions.
Unless the issue is confirmed to be attributable to LyonsBarry or otherwise required by applicable law, return shipping, customs charges, duties, taxes and other return-related costs are the customer’s responsibility.
Customers must not return products without obtaining return instructions or authorization from us.
Unauthorized returns may be refused, delayed or returned to the sender at the customer’s expense, subject to applicable law.
6. Refunds
A refund is issued only after the applicable claim has been reviewed and approved.
Approved refunds will normally be processed to the original payment method used for the order.
The time required for the funds to appear in the customer’s account depends on the payment gateway, bank, card issuer or financial institution.
A refund initiated by LyonsBarry may therefore take additional time to appear in the customer’s account.
Where available, we may provide a refund transaction reference, ARN, UTR or other payment reference as evidence that the refund has been initiated.
7. Customs, Import Restrictions & Delivery Refusal
International delivery generally takes approximately 7–35 days after dispatch, but customs clearance has no guaranteed deadline.
Customs inspections, government approvals, import restrictions, regulatory checks, duties, taxes, documentation requirements and other governmental procedures are outside our direct control.
The customer is responsible for complying with applicable import requirements in the destination country.
If a shipment is delayed, detained, refused, abandoned, returned or destroyed by customs or another authority because of destination-country requirements, customer-provided information, unpaid duties/taxes, missing permits, recipient non-cooperation or other circumstances outside our control, a refund is not automatically guaranteed.
Any refund request will be assessed according to the circumstances, recoverable costs and applicable law.
8. Incorrect Address or Customer Information
Customers are responsible for providing accurate and complete:
Name
Delivery address
Postal/ZIP code
Telephone number
Email address
Import or delivery information
We are not responsible for delays, failed delivery, additional charges, customs issues, return or loss resulting from incorrect, incomplete or outdated information supplied by the customer.
9. Refused or Unclaimed Shipments
Refusing or failing to accept a correctly addressed shipment does not automatically constitute cancellation or create an automatic right to a refund.
Where a shipment is returned, refund eligibility will be determined under this policy and applicable law after consideration of shipping, return, customs, carrier and other applicable costs.
10. Fraudulent or Abusive Claims
LyonsBarry reserves the right to investigate claims where there are reasonable indications of:
False damage or shortage claims
False non-delivery claims
Repeated refund requests
Duplicate refund claims
Manipulated or fabricated photographs/videos
Product substitution
Return of a different or used product
False payment or transaction claims
Abuse of promotional offers
Other fraudulent or materially misleading conduct
Where permitted by law, we may suspend or restrict future transactions associated with confirmed fraudulent or abusive activity.
We may retain and use relevant transaction, communication, shipping, delivery and payment records for legitimate fraud-prevention and dispute-resolution purposes.
11. Payment Disputes & Chargebacks
Customers are requested to contact LyonsBarry before initiating a payment dispute where the matter can reasonably be investigated or resolved directly.
Initiating a chargeback does not prevent LyonsBarry from providing transaction and fulfilment evidence to the applicable payment processor, bank, card network or dispute-resolution provider.
Such evidence may include order records, invoices, accepted policies, payment records, customer communications, fulfilment records, shipping records, tracking information, delivery confirmation and refund records.
Customers must not receive or retain duplicate compensation for the same transaction through both LyonsBarry and a payment dispute or chargeback.
12. Policy Acceptance
By placing an order, the customer acknowledges that they have had an opportunity to review the applicable Terms & Conditions, Shipping & Delivery Policy and Return, Refund & Cancellation Policy.
Electronic records of orders, policy acceptance, communications, payments, fulfilment and delivery may be retained for legitimate business, legal, accounting, security, fraud-prevention and dispute-resolution purposes.
13. Statutory Rights
This policy is intended to protect both the customer and LyonsBarry and shall be interpreted in accordance with applicable law.
Nothing in this policy is intended to remove, restrict or waive any statutory consumer right, warranty, remedy or protection that cannot legally be excluded or waived.
LyonsBarry® / Ballia Corpus reserves the right to update this policy when reasonably necessary. The version applicable to an order will be determined according to the records maintained for that transaction.
